The Kentucky Supreme Court is upholding the ruling by Franklin Circuit Judge Phillip Shepherd that declared the Senate Bill 151, the State Pension Bill, unconstitutional.
In a seven to nothing decision handed down Thursday morning, the Supreme Court sided with Kentucky Attorney General Andy Beshear who filed the lawsuit challenging the way the Pension Bill was passed by stripping the language out of a water and sewer bill and inserting the Pension Bill. The bill was passed during the final days of the 2018 Kentucky General Assembly.
In their ruling, the Kentucky Supreme Court stated their decision was not political in nature but was about making sure the law was upheld.
Kentucky Governor Matt Bevin says it’s a sad day for the Commonwealth.
Kentucky Attorney General Andy Beshear, who has since announced he is running for Governor, said he was pleased the decision.
Third District State Senator Whitney Westerfield says he was surprised by the unanimous decision by the Supreme Court.
Eighth District State Representative Walker Thomas says he was extremely disappointed by the Court’s unanimous decision against the pension bill.
Fourth District State Representative Lynn Bechler said the decision is troublesome.
Bechler adds the decision could have long-lasting effects.
Ninth District State Representative Myron Dossett says the decision does nothing to help the Kentucky Pension System.
Senator Westerfield says the ruling could have far-reaching effects.
Representative Dossett said he will continue to work to make sure the pension system remains in place and solvent.
The pension issue will likely be addressed during the next session of the Kentucky General Assembly.
