Attempted Murder Suspect Ready To Accept State Plea Deal

The Hopkinsville man charged with attempted murder from an incident in September will stick with his original plea agreement from November.

Brian Ellis entered an Alford plea where the attempted murder charges were dismissed and he faces seven charges of first-degree wanton endangerment, fleeing or evading police, tampering with evidence, and trafficking in meth. The total sentence for all charges would have equaled 15 years.

In January, Ellis showed up late for final sentencing, was arrested, and was charged with failure to appear. He since withdrew his plea and Peyton Wilson, an attorney from Paducah, began representing him.

Wilson asked Christian County Circuit Court Judge John Atkins Wednesday morning for a bond hearing, after a dispute whether Ellis’ mother requested to be removed as putting up a surety bond for his release.

Ellis said his mother was only trying to get his money back after his bond was raised to $100,000, after the failure to appear charge.

Another request from Ellis involved having more time to get personal affairs in order before being sentenced. Commonwealth’s Attorney Rick Boling said he had plenty of time.

Boling added Ellis should be prepared for sentencing at any time.

Judge Atkins asked Wilson to bring an affidavit from Ellis’s mother regarding her intention with the bond.

He also asked if there could be a compromise with the Commonwealth on a pre-sentencing release, although formal sentencing is now scheduled for next Wednesday, February 10.

Ellis was indicted by a Christian County grand jury on two counts of attempted murder, six counts of first-degree wanton endangerment, and multiple drug charges connected to a September 1 incident on Dawson Springs Road. Christian County sheriff’s deputies said he shot a gun at a home twice and then shot a car on Hart Road. Deputies said they determined Ellis was involved in both shootings, and he was arrested shortly thereafter on Wallace Avenue.
