Commonwealth Approaching Plea Agreement For Underwood

Commonwealth’s attorney Carrie Ovey-Wiggins and public defender Mary Rohrer are approaching a plea agreement in the case of Dustin Underwood, who is charged in connection with a May 2020 stabbing in southern Trigg County.

During Wednesday’s pre-trial conference in Trigg County Circuit Court, Rohrer noted to Judge C.A. “Woody” Woodall III that Ovey-Wiggins and her office recently provided a counter-offer for Underwood, who’s currently incarcerated at the Western Kentucky Corrections Complex for second-degree criminal attempt of arson involving an incident in 2017.

Underwood, who is charged with with attempted murder, possession of methamphetamine, possession of drug paraphernalia and being a persistent felony offender, was out on shock probation for the 2019 conviction of the attempted arson when in May 2020, he was booked by police on new charges — allegedly using a knife to cut a 35-year-old man’s jawline during a fight.

Another pre-trial conference has been set for 1:45 p.m. at January 12, 2022. Underwood has a trial date set for July 18, 2022.
