Trial Delayed Again In East 2nd Street Assault Case

The trial of a Cadiz man charged in connection to a shooting on East 2nd Street has once again been delayed after new evidence was presented by the Commonwealth’s Attorney at a hearing in Christian Circuit Court Wednesday morning.

Travis Mayes is accused of shooting Derrell Bateman in the abdomen on East 2nd Street on February 17, 2020. Bateman was flown to a Nashville hospital for treatment and identified Mayes as the shooter.

Mayes’ public defender, Doug Moore and Assistance Commonwealth’s Attorney Stephanie Bolen appeared before Judge John Atkins. Moore argued a motion he filed to exclude cell phone data that was collected earlier this month, in which he noted the phone has been in the possession of police for two years.

Bolen argued that Mayes has proclaimed his innocence from the beginning, but the cell phone data proves otherwise. She said the evidence is not beneficial to Moore’s client and that is why he wants it excluded.

Judge Atkins asked Bolen why it took so long for the cell phone data to be extracted if it was crucial evidence.

Moore stated Mayes wants to move forward with Monday’s trial, but Judge Atkins decided to delay the trial to July 7 to allow more time for the defense to review the evidence.
