Charged with attempted murder, possession of meth and possession of drug paraphernalia following a May 2020 altercation, 38-year-old Cadiz native Dustin Underwood entered a plea of guilty during Wednesday’s session of Trigg County Circuit Court.
Sentenced concurrently for five years, Underwood was also ordered by Circuit Judge Jamus Redd to serve these five years consecutively after finishing out his term for a previous charge of attempted arson.
Underwood was out on shock probation from that 2019 attempted arson conviction when, in May of 2020, he was booked by police on new charges — allegedly using a knife to cut a 35-year-old man’s jawline during a fight.
During the plea agreement, Redd noted had this case gone to trial, it would’ve been at the purview of the jury to stack all charges consecutively, rather than concurrently.
In exchange for this guilty plea, Commonwealth’s Attorney Carrie Ovey-Wiggins and her office made multiple amendments to Underwood’s charges, to which Redd made sure Underwood and his public defender, Cody Hooks, understood.
There will be no probation or shock probation for Underwood in this case, nor will there be a pre-sentence investigation since he’s already a state inmate. He originally had a trial date set for July 18, which was rendered moot with this plea.
Underwood was living on the South Road in Trigg County before his last arrest. He’s currently lodged in the medium-security prison Northpoint Training Center near Danville in Boyle County.
