Defense attorney Doug Moore and his client, 60-year-old Rodolfo Amaya, were granted graces Wednesday morning, when Circuit Judge John Atkins ruled for a one-month continuance to allow the review of recently turned-over discovery from the office of Commonewalth’s Attorney Stephanie Bolen.
The decision comes just one month after Moore and Bolen exchanged frustrations in open court.
All parties will reconvene at 8:30 AM, August 16.
Moore also asked the court to renew a bond motion, which in June meant the reduction of the $500,000 set upon his arrest.
Atkins noted this wasn’t the time to grant such, and that the Commonwealth was entitled to “proper notice.”
Amaya is accused of the March 5 shooting and subsequent death of 43-year-old Dante Welch along New Gritton Avenue in Oak Grove.
In a March preliminary hearing, officials with Oak Grove police testified that Amaya shot Welch following a dispute about loud music. The two were neighbors. Police also reported that Welch was sitting in a vehicle when he was shot twice in the head by Amaya, with a toddler in the back seat.
Amaya’s bond remains the same at this time.
