A mental evaluation is on the horizon for an Oak Grove man charged with the March murder of his neighbor over an alleged loud music complaint.

During Wednesday morning’s session of Christian County Circuit Court, Doug Moore, the attorney for Rodolfo Amaya, said he is still obtaining discovery in the case from the Oak Grove Police Department. During a June hearing, Moore expressed the same concerns over the timeliness of discovery that had yet to be turned over to him and his client at that time.

Moore also informed the court that once he had a chance to peruse the latest discovery obtained, he would likely enter a court order for an evaluation of his client. He also told Commonwealth’s Attorney Stephanie Bolen it would not be done through the state.

Oak Grove police said Amaya shot Welch after a dispute involving loud music and that Amaya and Welch were neighbors. Police said Welch was sitting in a vehicle and was shot twice in the head by Amaya with a toddler in the back seat.

A trial date was set for February 19. Amaya remains in jail under a $500,000 bond.
