Resolution in Princess Theater Murder Case Could Be Near

The three men charged in the death of a Hopkinsville woman outside the Princess Theater in 2021 saw their trial date that was scheduled for next week vacated on Wednesday with a possible conclusion on the horizon.

Jaquavian Spencer and Zamarius Humphries are charged with first-degree assault, being a convicted felon in possession of a handgun, and complicity in murder and assault.

The latter two charges were added by a grand jury indictment in August.

Former Commonwealth’s Attorney Stephanie Bolen sought the latter charges, telling the court that Spencer and Humphries began shooting at each other, which is what caused Deovion Day to begin shooting, striking Aniya Collins in the crossfire. Collins was pronounced dead at the scene while a second person, G’Teria Acree, showed up at the hospital with a gunshot wound to the leg following the altercation.

Day is charged with murder, first-degree assault, and being a convicted felon in possession of a firearm.

After going through the evidence, Commonwealth’s Attorney Maureen Leamy, who was elected in November, said she will be looking to dismiss the complicity charges that were added to Humphries and Spencer in August and would like to discuss a resolution with the defense attorneys.

Both have spent past court appearances seeking full discovery and all evidence in the case. Chewning told the court on Wednesday that a recent exchange filled in some gaps he had concerns with.
