A Crofton man and former pastor, 58-year-old Marvin Upton was sentenced in Paducah last week — receiving two years and three months in prison for fraud and tax offenses.
According to court documents, he als was issued three years of supervised release — all stemming from three counts of bank fraud and three counts of filing false tax returns.
Until recently, Upton was the leader of Crofton Pentecostal Church in Crofton.
The bank fraud charges arose from Upton’s scheme from 2013 until 2016, in which he defrauded one of his elderly parishioners who suffered from dementia.
During that same time period, Upton also submitted multiple false tax returns which omitted income from said fraud scheme.
There is no parole in the federal system, and Upton was ordered to pay $500,000 in restitution to the victim’s estate, and another $222,037 in restitution to the Internal Revenue Service — who investigated the case.
Assistant U.S. Attorneys Madison T. Sewell and Corinne E. Keel prosecuted the case, which was further investigated as part of the National Elder Justice Task Force and the Kentucky Elder Justice Task Force.
