A bill that would make it harder to refuse a blood alcohol concentration test for suspicion of drunken driving passed in the Kentucky Senate Tuesday.
The measure known as Senate Bill 74 is sponsored by Senator Whitney Westerfield, of Crofton and would allow police to seek a search warrant for the tests in all driving under the influence (DUI) investigations. The current law only allows police to seek a search warrant for tests in DUI investigations that involve serious injury or death.
In addition, the current law says the refusal of the tests can result in license revocation but have been somewhat blunted by the use of ignition interlocks, which are Breathalyzer-type devices connected to the ignition systems of vehicles.
The bill passed by a 31-4 vote and now goes to the House of Representatives for its consideration.
