Defense attorneys are still waiting for a forensic report in the case of Pembroke triple-murder suspect Christian “Kit” Martin.
A laptop computer that an investigator used to obtain cell phone evidence was reportedly corrupted and sent to the FBI Crime Lab in Quantico, Virginia. The full report concerning the computer is expected to be finished by the end of the business day on Friday.
Tom Griffiths, one of three attorneys for Martin, said the report should have been completed sooner.
Additionally, Griffiths requested an evidentiary hearing for a shell casing found at the South Main Street home, where Calvin Phillips was found dead. Griffiths said he believes the manner in which the shell casing was found shows a hole in the evidence chain of custody.
Griffiths added the shell casing was reportedly found on the back porch of the home. Special Prosecutor Barbara Whaley said the shell casing was found after the home received a thorough cleaning by a member of the victim’s family. Law enforcement was contacted immediately after it was found. The person in question lives out of state and will be questioned during a May 21 hearing.
Also, during Thursday’s hearing, Christian County Deputy Sheriff Scott Noisworthy and Lt. Leonard Smith answered questions from Special Prosecutor Alex Garcia and Martin’s attorneys concerning the process of gaining a search warrant to look through a safe.
During the investigation in February 2016, Lt. Smith worked as a detective with Kentucky State Police. Both were asked about conflicting dates on the search warrant concerning the safe, with a decision to be made by Judge Atkins during the next court appearance.
Martin is accused of the November 2015 murders of Calvin and Pamela Phillips and their neighbor Ed Dansereau. Pamela and Dansereau were discovered a few miles away in the charred remains of a car.
Martin, a former Fort Campbell soldier and later a commercial airline pilot, was arrested in May 2019 as he was ready to board a plane at the Muhammad Ali International Airport in Louisville.
