A special judge has set a date for a possible plea to be entered in the case against a former Hopkinsville High School band director facing sex-related charges involving minors.

Seth Peveler was indicted in June 2019 on four counts of third-degree rape, four counts of third-degree sodomy, and second-degree unlawful transaction with a minor. His wife, Hannah Peveler, was indicted on three counts of tampering with a witness.

During a pretrial conference in Calloway County Circuit Court Tuesday afternoon, Seth’s attorney Sands Chewning along with special prosecutor Dennis Foust appeared virtually before Special Circuit Judge James Jameson.

Chewning advised the judge that Foust had requested the hearing for a plea to be held in Christian County Circuit Court.

After some conflict with schedules for a sentencing date in March, Judge Jameson said they would set that date at the December 21st hearing in Christian County Circuit Court.

According to the indictment, the charges against Seth Peveler were lodged in May 2019. The rape charges are in connection to Seth allegedly having sexual relations with a student under the age of 18 while he was acting in his official capacity as the band director at Hoptown High. The sodomy charges accuse Peveler of deviate sexual activity with a student or students on four occasions. The unlawful transaction with a minor charge stems from the former high school band director allegedly providing marijuana to a minor and then having sexual intercourse with the female student. He resigned as band director in early May 2019. His trial was set to begin on January 5, 2022.

His wife, Hannah, resigned as the assistant commonwealth’s attorney in Christian County in June 2019 following her indictment for tampering with a witness after accusations she attempted to induce witnesses to not testify against her husband. Her case is still pending.
