A release on recognizance motion for Hopkinsville’s Devon Poindexter was denied by Judge John Atkins in Christian County Circuit Court Wednesday morning, but things may change when all parties reconvene September 13.
Arrested and arraigned in connection to a shooting that injured 34-year-old Benjamin Murray in the leg, defense attorney Jason Holland said his client was in the middle of a successful felony pretrial diversion for wanton endangerment, and that recent Facebook posts from Murray’s girlfriend claimed Murray accidentally shot himself.
Commonwealth’s Attorney Stephanie Bolen said her office opposed the motion because a gun was involved with Murray, and Poindexter didn’t need to be associated.
Holland wanted to clear the message entirely, noting Poindexter never had a gun in his possession.
Atkins asked for this video discovery be turned over to the Commonwealth, as well as local authorities, and is seeking this resolution before he further decides on any release.
Holland entered that his client could afford the ankle monitor service, if it was necessary. Poindexter, he said, has been a long-time employee of Brazeway LLC, has never missed a court date, has never had trouble finding work, has strong family support, and “looks forward to defending himself” in this case.
Poindexter’s revocation of diversion was also continued to a later date.
Police originally indicated that Poindexter took the gun from the scene after the shooting to keep it from law enforcement. He’s charged with first-degree assault, first-degree wanton endangerment, tampering with physical evidence, and possession of a handgun by a convicted felon.
